New employee started today.

Looks 4 months pregnant.

I didn't ask though.

Have I failed my duty of care obligations?

While it's not appropriate to ask if an employee is pregnant, you can:

Invite them to share any needs or concerns they may have about their work environment.

Ask about their well-being and if they need any support in their role.

Discuss any changes in performance or attendance without mentioning pregnancy.

Depends does her job involve anything that could endanger her baby? If so then yes she should be made aware. If not and she hasn’t told anyone she’s pregnant then you can’t really say anything. Especially if it turns out she isn’t pregnant 😬

Tricky one. You have to be so careful what you say these days. Will she still be in your employ in 5 or 6 months time when alleged baby is due. If you have other female employees it might be an idea to get them to have a discreet word

Years ago my workplace took someone on who was pregnant...she was problematic on her return after maternity leave,turns out she had a drug problem,stole was temperamental etc...she eventually left when the manager who took her on and felt sorry for her was dismissed for bullying

Years a go we ran a pub and took on an assistant to help with accounts who was pregnant. It was the best move we made. She had her baby and worked from home during and after the birth. She supported by us took her bookkeeping course and now works for an accountancy company.

She was a single mum and we had to keep telling her to slow down.

Sometimes it can work, follow your heart.

I was in a mental health hospital and they let a pregnant woman stay working til she was 6 months along... That is too long for me esp in those conditions some may have got violent. It's not worth the risk.

If the job might put her pregnancy at risk then it should be considered. At some point she will have an obligation to officially inform you because of maternity pay and leave. Maybe check out the ACAS website for guidance.

It's not risky work. But I would need to conduct a risk assessment. I'm fully aware of maternity procedures, I've done them loads of times.

Just do the risk assessment and add to the health and safety folder, then send an email to everyone saying the H&S folder has been updated please read and sign

I can't do the New and Expectant Mother's Risk Assessment if she doesn't declare the pregnancy.
