Dividing a parents assets with a sibling you don’t get on with after their death ?

It’s not your decision to make !

If there is a will in place then that will be decisive !

If no will in place then probate will distribute all assets equally to debtors 1st then onto siblings or the beneficiaries

It’s then down to the beneficiary to distribute the assets accordingly!

I’m not sure there is any legal obligation to distribute the assets by the beneficiary

But as the saying goes “ where there’s a will! There’s an argument about to happen!”

What normally happens is probate gather all the deceased assets together and work out a cost then split it even between the closest family

The family can then decide what to do with their share e.g. sell your half of house to other family but get independent legal advice

Unfortunately without a will probate will now step in as previously mentioned and they now divide up the assets!

In England, where there is no Will the rules of intestacy apply. Just follow those and you cant go wrong.

Do you have access to the house? If you do it may be worth making a record of anything of value, maybe take photos. I know of one person whose sibling (a Police officer!) stripped the house of anything valuable he wanted before the formal process began. Hopefully your sibling won't be dodgy and things will progress without similar behaviour.

When there is no Last Will and Testament the Rules of Intestacy apply, if there's no spouse, the estate will be divided equally between the children. They'll inherit everything.

In the case of a strained relationship between siblings it may be worth engaging a solicitor to ensure everything runs fairly and smoothly, especially if there are any complications with the estate, such as property being involved which is a bit of a legal minefield these days.

In the wake of your parents death I’d like to think you could be civil one final time to respectfully divide what material things is left of them.

If you don’t think either of you can be adult enough then pay a solicitor to do it
